Mexico Expands NOM-221 Import Compliance

Back

Mexico has amended Annex 2.4.1 of the General Rules and Criteria on Foreign Trade. The amendment expands the tariff classifications linked to NOM compliance for certain telecommunications products at the point of entry.

This change is especially relevant for Mexico NOM-221 compliance. It covers products within the scope of NOM-221-SCFI-2017 and NOM-221/2-SCFI-2018.

Annex 2.4.1 lists the tariff classifications that require compliance with Mexican Official Standards at import or export. The Ministry of Economy identified several telecommunications classifications that the Annex did not previously include. However, products under those classifications already fell within the scope of the corresponding NOMs. ACUERDO que modifica el diverso…

Mexico NOM-221 Compliance Expands

The Ministry of Economy added several tariff classifications for NOM-221/2-SCFI-2018. These include:

NOM-221/2-SCFI-2018 covers certain mobile terminal equipment. The scope includes equipment that can use radio spectrum in specific frequency bands. It also covers equipment that can connect to telecommunications networks.

The listed bands include 700 MHz, 800 MHz, 850 MHz, 1900 MHz, 1700/2100 MHz, and 2500 MHz. ACUERDO que modifica el diverso…

The amended Annex now links these tariff classifications directly to NOM-221/2-SCFI-2018. Therefore, companies should verify whether their products meet the scope described in the Annex. ACUERDO que modifica el diverso…

Additionally, tariff classification 8517.18.99 now appears under both NOM-221-SCFI-2017 and NOM-221/2-SCFI-2018. The applicable requirement depends on the product description and scope established in the Annex. ACUERDO que modifica el diverso…

What Does the Amendment Change?

The amendment does not introduce new frequency bands. It also does not modify the technical specifications of the NOM-221 standards.

Instead, Mexico updated its foreign trade framework. The change connects additional tariff classifications with existing NOM requirements at the point of entry.

As a result, importers and manufacturers should review the tariff classification and applicable NICO for each covered product. They should also confirm which NOM applies before customs clearance.

The amendment also includes classifications 8517.62.17 and 8517.69.99 under NOM-221/2-SCFI-2018. This applies when the products meet the mobile terminal equipment conditions described in the Annex. ACUERDO que modifica el diverso…

When Do the NOM-221 Changes Take Effect?

The agreement establishes a specific transition period for the telecom provisions.

Most provisions enter into force the day after publication in the Official Gazette. However, the Ministry established a different timeline for NOM-221-SCFI-2017 and NOM-221/2-SCFI-2018.

The NOM-221 provisions take effect 30 business days after publication in the Official Gazette. ACUERDO que modifica el diverso…

Companies that import covered telecommunications equipment should review their classifications before that deadline. They should also verify that the required NOM compliance documentation supports the applicable products.
