Brazil – Public consultation No. 44 – Technical and operational requirements for the use of frequency bands associated with the private limited service, provided by terrestrial systems

The objective of this Public Consultation is to approve the Technical and Operational Requirements for the use of radio frequency bands intended for the private limited service, provided by terrestrial systems, and assigned to the fixed service or the mobile service. And to revoke:

I – Act No. 6.053, of October 14, 2020, which approves the Technical and Operational Requirements for the use of the 2.485 MHz to 2.495 MHz band for use by stations in the Private Limited Service – SLP;

II – Act No. 4.800, of September 1, 2020, approving the Technical and Operational Requirements for the use of bands above 2 GHz for fixed service applications;

III – Act No. 3.037, of April 30, 2021, which amends Act No. 4.800, of September 1, 2020;

IV – Act No. 1.132, of February 19, 2021, which approves Technical and Operational Requirements for use of the 1.437,75 MHz to 1.452 MHz and 1.503,25 MHz to 1.517 MHz bands by fixed service digital systems in point-to-point applications;

V – Act No. 8.991, of June 27, 2022, which approves the technical and operational requirements for use of the 3.700 MHz to 3.800 MHz band by low-power terrestrial service stations;

VI – Act No. 8995, of June 27, 2022, approving the technical and operational requirements for use of the 27.5 GHz to 27.9 GHz sub-band by stations in the Private Limited Service (SLP), Multimedia Communication Service (SCM), Personal Mobile Service (SMP) and Fixed Switched Telephone Service (STFC);

VII – Act No. 14.452, of October 13, 2022, which amends Act No. 4.800, of September 1, 2020.


The public consultation also establishes changes to the following bands:

30 MHz to 50 MHz (Point-to-point / Point-to-multipoint / Point-to-area);

72 MHz to 76 MHz (Point-to-Point / Point-to-Multipoint);

148 MHz to 174 MHz (Point-to-multipoint / Point-to-area);

217 MHz to 400 MHz (Point-to-Point / Point-to-Multipoint / Point-to-Area);

400 MHz to 470 MHz (Point-to-Point / Point-to-Multipoint / Point-to-Area);

806 MHz to 943.5 MHz (Point-to-Point / Point-to-Multipoint);

1437.75 MHz to 1517 MHz (Point-to-Point);

2 GHz to 8.5 GHz (Point-to-point);

2,390 MHz to 2,400 MHz (Point-to-multipoint / Point-to-area);

2.485 MHz to 2.495 MHz (Point-to-multipoint / Point-to-area);

3.700 MHz to 3.800 MHz (Point-to-multipoint / Point-to-area);

4.910 MHz to 4.990 MHz (Point-to-Point / Point-to-Multipoint / Point-to-Area);

10 GHz and 11 GHz (Point-to-Point / Point-to-Multipoint);

13 GHz to 19 GHz (Point-to-Point);

27.5 GHz to 27.9 GHz (Point-to-multipoint / Point-to-area);

23 GHz to 90 GHz (Point-to-Point / Point-to-Multipoint).

FINAL AND TRANSITIONAL PROVISIONS

6.1 No new authorizations for the use of radio frequencies may be issued or existing authorizations associated with the private limited service extended, under conditions of use other than those set out in these Technical Requirements, without prejudice to the licensing or consignments associated with the provision of the service, unless specifically provided otherwise. 

6.2 Previously authorized systems may continue to operate in accordance with the conditions of use in force on the date of the respective authorization to use radio frequencies, until September 7, 2028, or for the remaining term of the authorization, whichever comes first, without causing harmful interference or requesting protection from stations authorized in accordance with the conditions set out in these Technical Requirements.

6.2.1 After the date set out in item 6.2, consignments that do not comply with the conditions set out in these Technical Requirements will be excluded from Anatel’s technical and administrative database (BDTA).

6.3 For systems associated with point-to-point applications, corresponding to items 5.10, 5.15 to 5.16, and 5.18, as of January 1, 2026, no new stations may be licensed or new radio frequencies assigned to already licensed stations, in disagreement with the minimum link distance and minimum antenna gain requirements, which are the subject of these Technical Requirements.

The final date for contributions for this is September 28th, 2023.
